My Dilemma re My Son’s Hearing for Violating my Restraining Order

My 27-year-old alcoholic son’s court hearing for violating my restraining order from my house is on Monday (he was to stay 10’ from my house). I’m going to be in NY, but I just got a Victim’s Rights Request form in the mail. It asks if I want to:

Confer with the prosecutor

Be notified of court hearings

Be present at proceedings

Be heard at proceedings

Be notified of the conclusion

My son’s currently in rehab and has now agreed to stay 100 feet away from me per the prosecutor’s deal. However, the deal was based on the incorrect police report (the police put down the wrong penal code when there was no battery). I’m going to attend the new hearing by Zoom to testify that there was no battery but here’s my dilemma:

My son’s fully expecting me to honor my word and let him come back home if he completes the rehab program

My 84-year-old mother with dementia, who misses him, now lives in my house

My mother’s 94-year-old boyfriend, whom my son scared when he wouldn’t stop banging on the door and window, now lives in my house

My 26-year-old daughter, whom my son scared the last time he was living at home, lives in my house

Do I break my promise to my now sober son and remove all hope he has of being with his family by telling him be can’t come home after rehab?
